HIPAA - Guaranteed Issue Plan
The
Health Insurance Portability and Accountability Act of 1996 created the
opportunity for individuals leaving employer sponsored plans (group
health insurance plans) to qualify for guaranteed issue individual
health insurance. They must meet certain qualifications. To qualify for a
HIPAA plan, you must:
- have completed a minimum of 18 months of continuous health coverage, most recently under an employer sponsored group health plan.
- have elected and exhausted continuation of coverage under COBRA, if available
- have lost coverage within the last 63 days
- not be eligible for Medic-aid or Medicare, or have any other health coverage
- Additional requirement apply. Ask your broker if you qualify for a HIPAA plan and if a HIPAA plan is right for you.
Options When Leaving a Group Plan
Be
sure to ask about all of your options when leaving a group health
insurance plan. If you understand all of them you will be able to choose
the best health insurance for the future. Some choices are guaranteed
issue regardless of health history and others are not. Prices, benefits
and coverage will vary widely. A good broker can walk you through the
options. The options may include: Federal COBRA (groups with 20 or more
employees), individual conversion plan, extension of benefits if totally
disabled, HIPAA guaranteed issue plan, or medically underwritten
